本文檢視我國各級法院的判決中,就勞動基準法中有關勞動條件的規定,對部分工時勞工如何適用?首先從部分工時勞工的均等待遇原則出發,闡明其基本觀念,接著逐一檢討部分工時勞工的正常工時工資、假日與續付工資、延長工時與加班工資、職災補償、資遣費與退休金等勞動條件,是否與全部工時勞工受到均等待遇?目前我國各級法院判決中,並未明白揭示部分工時勞工的「均等待遇原則」。然而,在具體的個案中,法院原則上就勞基法中所規定的勞動條件,對部分工時勞工作同樣的適用。然而,也有一些法院的判決忽視部分工時勞工的特性而有差別待遇。本文認為勞動法上的「一般均等待遇原則」、國際公約與外國立法例中有關部分工時勞工的「均等待遇原則」,可作為法理加以適用。此有待法院的明白揭示與進一步的具體化。對部分工時勞工的勞動條件及其他保障採取特別立法,也是未來可以考慮的方向。
This article concern on the working condition of the part-time worker. We analyze the application of Labor Standard Act in the decisions of our courts. In the first, the principle of equal treatment for the part-time worker are considered. And then we examine whether the part-time worker is treated in a less favorable manner than comparable full-time worker. The regular wages, overtime wages, holiday and leave wages, compensation for occupational accidents, severance fee and retirement payment are separately examined. It is concluded that the part-time workers are treated generally equally about wages condition in the decisions of our courts.
