摘要

2000 年我國制定了《國防法》及修訂《國防部組織法》（國防二法），但何以行憲迄今近五十年始完成立法？本研究主要透過文獻探討、相關參與者之訪談分析，從國防部、行政院及立法院三個體系進行探討，藉以了解「國防二法」從起草規畫、審查經協商至法案通過各階段之過程與相關成功因素，並分析「國防二法」條文在立法中一些爭議點與意涵。本研究認為「國防二法」之推動，主要在解決我國長期以來「軍政軍令一元化、文人統制、軍隊國家化、聯合作戰」等問題，而前國防部長唐飛角色更具關鍵，在其主導下，踏出國防體制和組織再造與變革的第一步。

In 2000, Taiwan finally enacted the “Two National Defense Acts.” The purpose of this study is to examine various aspects of their legislative process in depth through literature reviews and interviews. It will depict the process and key factors from drafting, reviewing, negotiating to pass the “Two National Defense Acts” in the Ministry of National Defense, the Executive Yuan and the Legislative Yuan. Some other articles will also be discussed and explained. The “Two National Defense Acts” primarily deal with the problems of “unified military administration and command, civilian control, nationalized armed forces, and joint operation”. Tung-Fe, the former minister of National Defense, had played an important role in the enactment of the two Acts and defense reorganization.
