歷經漫長之政治妥協及立法時程,攸關我國最高行政機關——行政院之組織法終於在2010年順利完成立法。由於行政院運作良好與否,重大影響國家、社會的長久發展並直接涉及人民權益,因此行政院組織必須能夠反映國內外政經情勢的發展、因應國家政府職能的變化以及符合人民利益的需求與期待,而適時地作必要的調整。本文之目的探討現行行政院組織法及相關部會組織法之修正與制定結果,首先針對政府組織改造之背景及依據加以說明,自歷史回顧中知悉政府組織之現況與面臨之難題、法規範面之限制與突破、說明歷次行政院改造之目標、設計原則與調整藍圖;接著介紹目前行政院組織改造法案之現況;最後則就現行組改成果,從立法程序與技術、組織法律保留、行政院院本部、部與委員會、獨立機關、行政法人以及員額部分加以分析檢討並提出建議,提供未來適用法律與再修法時之參考。
Struggled for a long period to reach a political compromise, the Congress of Taiwan successfully adopted ”the Organization Act of the Executive Yuan of 2010 (OAEY)”which is crucial to the highest administrative organ in our country. Whether the Executive Yuan could function well not only has a far-reaching impact on the development of our country and society but also directly concerns with the welfare of the people. Thus, the organization of the Executive Yuan must respond to mountainous challenges arose either domestically or abroad. It must also adjust duly to conform to the public interests and changing roles of government. This article aims at exploring the OAEY, relevant amendments to administrative agencies and their outcome. It first explains the background of the Organization Reform for the Executive Yuan and its basis. From a retrospective point of view, this article ascertains the existing circumstances of the organizations, difficulties, limits and breakthroughs of the regulations, goals of reforms, principles of design and prospect. Secondly, this article expounds the present conditions of the OAEY. Finally, it analyzes what results have been brought by the Reform, ranging over legislation process and techniques,organizational delegation from the Congress, head office of the Executive Yuan, ministry and commission, independent regulatory commission, administrative corporation and quota of personnel. After reviewing those issues above-mentioned, these articles will propose helpful comments for the application of the Act and its further amendments.
