摘要

本文主要是探討以刑罰貫徹勞動法規範的勞動刑法之議題。從檢討勞動刑法的定義，形成刑法與勞動法的切入角度，並以勞動者保護的理念貫穿其中，呈現並檢討我國既有勞動刑法體系之問題與不足點。按照本文見解，在刑法規範與勞動法規範交錯情況下，藉由刑法法益保護機能的探討，以及發展中的國際刑法觀點，可以獲致勞動刑法刑罰規定的合理性與可罰性，並藉此建構起勞動刑法的新架構。

This study mainly focuses on the issues about attaining the ideas of Labor law through criminal law. Generally, that is called labor criminal law. From the beginning, by discussion of its definition, this study finds there are two visions, of Labor law and of Criminal law, to approach this problem. Then, accompanying with exploration of the ideas of labor protection, this study concludes some problems and shortages of current labor criminal law. According to this study, some labor criminal codes have their legal interest and therefore are reasonable. On the other sides, some labor criminal codes have their deficiency in the light of developing international criminal law concepts. A new structure can be reached by combining all of them.
