摘要

由於復康哲學與少年保護思潮的影響，各國少年司法紛相採用轉向計畫。西方國家轉向計畫的作法，大都以青少年之犯罪類型較輕微者，以保護處分及社區處遇的社福機構或心理衛生機構爲主，將青少年留在家庭，來接受社區所提供的服務，此類方案的優點能讓犯行輕微的少年回歸正常的家庭系統，增強家長責任及家庭之功能，更具有避免少年進入司法體系的標籤作用。本文分別對美國、德國、香港、臺灣等地區進行文獻收集與比較論述，提出跨專業合作、清晰介定處理的準則、設立單一窗口的轉介及評估機制、有效運用各項社區服務、強調違法少年及其家庭的參與等建議，期使國內轉向實務更趨完善。

Due to ethos of rehabilitation and juvenile protection, many countries have adopted juvenile diversion programs.
In the Western countries, most of probation programs for juvenile delinquent are protective proceeding and community treatment by social welfare and mental institute. It helps juvenile delinquent to stay at home, and they can receive social work service in community.
The advantage of diversion programs is to keep juvenile delinquent away from the label of crime and justice administration. And it also can enable parental responsibility and improve family function to help juvenile delinquent to go back home.
The study compares the diversion programs in America, Germany, Hong-Kong, and Taiwan. There are four suggestions demonstrate in this paper. The end of this paper is to build a more complete diversion program and probation system in Taiwan.
