On the Third Party of WTO Arbitration

摘要


WTO仲裁制度是以普通仲裁條款為核心,以特殊仲裁條款為輔助,以DSU之外其他協定仲裁規定為補充的多層次法律制度。第三方憑藉其獨特的地位,在WTO爭端解決中發揮著越來越重要的作用。目前,幾乎所有進入WTO爭端解決程式的案件都會有一個或多個第三方參與其中。雖然DSU對第三方介入制定了一些原則規定,但是這些規定主要適用於評審團審理程式,對於仲裁中的第三方介入幾乎沒有涉及。在實踐中,WTO仲裁員在缺乏具體規定時,除了類推適用評審團審理中有關第三方的規定外,還會處理第三方在仲裁中的准入資格及權利等問題。因此,WTO仲裁第三方所享有的權利是不穩定的,在實踐中也容易成為各方爭議的焦點。

The arbitration in the WTO is based on the normal arbitration clauses together with some special arbitration clauses of DSU and those relevant provisions of other multilateral agreements. With its unique status, the thirdparty is playing an important role in the WTO dispute settlement. At present, almost all the disputes brought to the DSB engage (a) third-party or third-parties. Although there are some basic provisions in the DSU to regulate the activities of third-parties, they are mainly designed for the panel process. Few provisions are made in the DSU solely for the third-parties in the arbitration. Article 25 of DSU provides only the possibility of arbitration for the disputing parties in some situations. It does not lay down the procedures as Article 12 or Article 17 of DSU. Without the specific rules, the arbitrators are expected to deal with the qualifications and rights of third-parties within their discretion in relevant cases apart from drawing an inference from the panel process. Therefore, the rights of third-parties in WTO arbitration are unstable. In practice, they tend to become the point at issue. After reviewing the international arbitration practice and the experience of NAFTA, the authors of this article put forward the suggestions on the modification of DSU arbitration clauses, especially on the rights of disputing parties in the WTO arbitration.
