摘要

家庭暴力防治法自民國87年全面實施後，經過十一年，通報案件次數約以20%的穩定比率成長，去年（民國97年）1月至9月之通報次數即達53,064件。相對於通報率，國內加害人進入處遇計劃則仍屬偏低。根據97年1月至9月統計，保護令核發案件共8,604件，其中僅952件裁定強制加害人完成處遇計畫，約佔核發通常保護令之11%。爲什麼?原因很多，加害人參與意願不高、法官個人對處遇計畫之認知差異、以及相關配套不足，都是法院裁定比例低的因素。
這篇論文係以參與地方法院的一項相對人認知輔導教育方案的行動研究，藉由方案實施過程，探討參與的相對人、社工、帶領課程的心理師、律師以及法官互動，了解目前家庭暴力防治之問題與挑戰。結果研究，發現家暴服務各相關業務單位各自爲政，缺乏溝通網絡與機制，對於個案裁處容易產生歧見。因此，建議法院、醫療機構與社工間能夠落實平台溝通的機制，藉由平台，定期交流建立網絡關係，加強法官、醫療人員與社工彼此之間的對話，以及對社工專業的認同。

Ten years after the Domestic Violence Prevention Act enacted, the Domestic Violence report rates has been steadily increasing while the court-order batterer education programs issued by the judge still limited. Reasons are including the batterer is reluctant to participate the program, the recognition the importance of the batterer education programs by judges are varied, and the measurements of the programs are insufficient.
This paper is an attempt to explore the interactions among the batterers, social worker, facilitators, and the judges through an action research on the cognitive education program in a local court to understand the problems and the challenges of domestic violence. This study found that there is no sufficient communication among the domestic violence agencies, most of them are on their own. The coherent networks and more cooperation are needed among the domestic violence agencies. In particular, the justice system and the judicial yuan need to play the leading role to stop violence against women.
