中小型分子檢測醫療器材廠專利布局-以 B 公司為例

專利對於企業而言，是一種技術能力的展現，是一種防禦的工具，同時也可能是在商務談判時的籌碼，其重要性更是不言而喻。以發明專利為例，從如何在企業的技術中找到可申請的專利點開始，到專利的申請開始，再到專利權有效的二十年期間，所需的費用及人力成本所費不貲，如何找到可實施專利的技術，對公司而言是非常重要的議題，尤其是現今競爭激烈的分子檢測產業。本文透過由經濟部智慧財產權局建置的全球專利檢索系統(GPSS)，以專利檢索的方式，分析我國及美國、歐洲、日本、韓國、中國大陸等，五大智慧財產局的專利資料，從大範圍的生技醫藥業及醫療器材製造業，再限縮到分子檢測市場的專利分佈，分析專利的佔比、數量及趨勢。最後以中小型分子檢測公司的角度出發，分析在市場上兩間相同類型公司的專利布局，並提出公司未來可行的方案及專利布局方向。

For an enterprise, patents are showing the signal of their technical capabilities, a tool for defense when facing litigation, and may also be a bargaining chip in business negotiations. Their importance is self-evident. Taking invention patents as an example, first, we need to find a patentable technology in the company, second, apply for patent, and then maintain it for 20-year period when the patent is valid. It will require expenses and labor costs. Finding a patentable technology is a very important issue for companies, especially in today's highly competitive molecular diagnostics industry. Through the Global Patent Search System (GPSS) established by the Intellectual Property Office of the Ministry of Economic Affairs (TIPO), this thesis analyzes the patent information in Taiwan and also the five intellectual property offices including the United States (USIPO), Europe (EUIPO), Japan (JPO), South Korea (KIPO), and China (CNIPA) by means of patent search. From the large-scale biotechnology pharmaceutical industry and medical device manufacturing industry, and then narrowed to the molecular diagnostics patent distribution, the proportion, quantity and trend of patents are analyzed. In the end of this article wish to propose the feasible patent strategy from the perspective of small and medium-sized molecular diagnostics companies, by comparing the patent strategy of two companies of the same type in the market.
