司法精神鑑定之家庭殺人犯罪個案之相關因素探討

發生於家庭成員間之殺人犯罪事件是嚴重的社會問題，而值得更深入的探討。本研究目的為第一：針對家庭內男女家庭殺人案件發生的成因、犯罪手法與犯罪過程。第二：藉由精神鑑定書的基礎做為分析依據，瞭解家庭殺人犯罪的相關因素。若要真正深入了解殺人犯的內心世界，我們必須針對性別的差異做比較。本研究針對近二十年來(民國七十二年至民國九十二年)國內高雄市內某一醫院評鑑之家庭殺人事件的相關資料(精神鑑定書、病歷、法院的判決書)逐一閱覽，共計有78件案件，並進行家庭殺人犯罪的統計分析。結果發現： ?? 加害人以壯年為主，教育程度以國中以下為多，社會階層低。 ?? 男性加害者多以殺傷父母(47.3%)、其次配偶(17.6%) 女性加害者多以殺傷子女(47.1%)，其次配偶(35.3%) ?? 加害人多以男性壯年為主，被害者以受害者以小孩及老人居多。 ?? 犯案當時精神狀況分別以出現攻擊或破壞行為(47.4%),妄想(41%),不能控制的衝動(38.5%)為主。女性加害人於犯案當時的精神情況則以破壞行為(60.0%)、妄想(46.7%)、嚴重憂鬱症狀(40.0%)為主。 ?? 男性加害者以精神分裂症(39.7%)、藥物/物質濫用(28.6%)、妄想性精神病(15.9%)為主；女性加害者以精神分裂症(46.7%)、妄想性精神病(20.0%)、精神官能症(13.3%)為主為防止類似的悲劇發生，唯有整合教育、警政、司法與醫療等單位，方能提供台灣一個有效的防治策略
