勞工保險條例修正問題之研究-以各項給付競合為中心

摘要


勞工保險是台灣給付項目涵蓋最廣,且投保人數達七百餘萬人的社會保險,可以說是台灣社會安全體系最重要的支柱;在勞工保險的各項制度中,對勞工保險被保險人而言,最重要的保險權利即為保險給付請求權。而行政法院實務案例中,被保險人同時或先後符合多項保險給付要件時,保險給付經勞工保險人扣減、請求擇一或僅發給差額後,被保險人往往因為缺乏對於眾多勞工法令與行政院勞工委員會函釋之認識,而對給付的減給有無法理解認同的反感,致被保險人認為自身給付權利遭受侵害,並向行政法院提起訴訟;此類案例又往往因原告缺乏對法令及行政機關函釋的理解,而大多以敗訴告終,除了使被保險人支出不必要的勞費之外,更將造成司法資源的浪費。 本文除了就勞工保險條例之修正內容作簡單的說明與探討之外,並針對被保險人請領失能、老年及死亡給付的各種競合情況下的行政法院判決及行政機關函釋作整理歸納,並於探討法律適用之際,兼探討新修正勞保條例年金給付制度對給付競合適用可能造成的影響。 最後,本文嘗試從文中所討論之各種勞工保險給付競合情況歸納出給付發給的考量要素,並就新、舊勞保條例可能發生的制度變革以及需要檢討改進的條文內容作討論,以期對勞工權益保障能夠有所助益。

Taiwan's labor insurance is the most extensive payments project, and the number of the insured is more than 700 million people in the social insurance. It can be said that it is the most important pillar of Taiwan's social security system. Among items of the labor insurance system, one of the most important rights for insurant is to claim insurance benefits. In the administrative court cases and practice ,when the insured matches many insurance payment requirement simultaneously or successively, but after the insurance benefits were deducted by the labor insurer,select sole request or only pay the difference, the insured can not understand and identify with the reduction which is often due to the lack of understanding to the numerous labor decrees and Executive Yuan labor committee’s interpretation. So the insured think their own rights to claim have been violated and litigate to the administrative court. Most of such cases end in failure because the plaintiffs often lack of understanding to the decrees and the administrative institutions’ interpretation. Apart from the insured spend unnecessary labor cost, also it result in a waste of judicial resources. This paper, in addition to make a simple description and discussion to the amendment of the labor insurance act, it also generalize Administrative Court’s judgment and the administrative institutions’ interpretation to concurrence of the disability on application, old age and death payment and so on. This paper investigate the application of law, at the same time research the possible influence of payment concurrence which caused by the pension system in the amendment to Statue for Labor Insurance. Finally, this paper attempts to conclude the insurance benefits criteria from the discussed concurrence of various labor insurance benefits, and to discuss the possible institutional changes of the old and new labor legislation and the regulation content which need to review and improve, in the hope of help to protect the labors’ rights.
