司法審查之表述功能與社會變革：以性別平等原則在家庭中的落實為例

摘要

性別平等為憲法所保障之重要價值，不僅應落實於職場或其他的社會場域，正如大法官第365號解釋所明白指出，「在家庭中亦有適用」。近年來，在大法官多號解釋的適時推促之下，原來我國親屬法中的許多不平等條款，多已逐一被性別中立、平等的新規定所取代。然而，傳統父權規範所建構的性別秩序，至今仍深植在我國的家庭制度之中。本文認為，欲落實「消除性別歧視，促進兩性地位之實質平等」的憲法任務，不僅需要在法規範上進行典範轉移的工程，更需要對由來已久父權家庭規範進行檢討改革，俾使性別平等成為法規範(legal rules)以及社會規範(social norms)的共同價值。而釋憲者若能進一步發揮司法解釋的「表述功能」(expressive function)，將更能促進國人對基本人權核心價值的瞭解與重視，並活絡社會上對性別平等議題的溝通與討論。越多切實、深刻的司法論述，越能成為公眾思辯的催化劑，而性別平等原則的落實，也就有了越具體的希望。

With big pushes from the Grand Justices and the blessing of the legislature, Taiwanese family law has experienced a major transition in recent years. Gender equality has become the new norm of the family law. However, such paradigm shift in law has not yet translated into the substantial change in the real word, for the patriarchal tradition still casts a huge shadow on Taiwanese family practices. This article urges the Grand Justices to help combating the patriarchal norms by utilizing the expressive function of their Interpretations. That is, more profound judicial discourses would ignite and/or enrich more social dialogue and discussion on the issue of gender equality, and eventually help the transition in social norms and the change in society.
