摘要

智慧聯網係由資通訊技術與電信基礎建設所串連支持，而關鍵應用之基礎要件就是資料（data），並且搭配巨量資料、雲端運算等科技發展，使得資料被蒐集利用的速度愈加迅速，資料內容亦更多元。新興科技雖可為產業帶來更多商機，為生活帶來更多便利，但也同時對人們的隱私造成更大的侵犯隱憂，並衍生出許多過往未曾思及的個人資料保護議題。為強化線上隱私權利保護，歐盟執委會於2012年1月對於個人資料保護指令提出新修法：「一般資料保護規章」（草案），並以於 2013年6月進入正式審議程序。歐盟為因應智慧聯網環境之新修法工作，當可為我國「個人資料保護法」規範，帶來可為借鏡之參考，值得探討，協助我國未來建立更完善產業應用發展法制環境。

Internet of Thongs system through information and communications technology and telecommunications infrastructure and operations. The key factor is the application of ＂data＂, and with the ＂Big Data＂, ＂Cloud Computing＂ and other technological development, making the data is collected even more rapid pace, the content of data is also more diverse. Although Emerging Technology can bring more business opportunities for the industry, for the life more convenient, but also on people’s privacy concerns cause more violations, and spawned many not previously thought and personal data protection issues. In order to strengthen online privacy rights, the European Commission in January 2012 for Personal Data Protection Directive amendments proposed new law: ＂General Data Protection Regulation＂ (draft), and in June 2013 into the formal review process. The revised draft EU law can be used as a reference for our country. Look forward to assisting our future to build a better legal environment for the development of industrial applications.
