摘要

本文簡要討論政府資訊和出版品等電子化時所涉及的授權架構原則。目前我國正積極推動電子化政府之建置工作，開放政府資訊供私部門加值利用是重點之一，將政府出版品釋出也是極為重要的一環；然而，除了智慧財産權系列法令、檔案法、科學技術基本法和市場公平交易相關法令等一般性的法律規範，以及散見於各政府機關的行政命令和內規之外，並無一整套完整的政府資訊和政府出版品加值利用和授權之規範，針對可以進行加值利用和授權的政府資讀和政府出版品之範圍、類型、進行模式和收費方式等規定，欠缺一致性的規定，或許是相當值得思考應該如何改進之處。同時，政府資訊公開法則是截至目前為止尚未立法，使得攸關資訊公開的權利義務事項無從有更為具體的規定，間接地也影響了政府資訊和政府出版品電子化授權架構的完整建立和執行進程，也是甚屬遺憾而應該儘速補強的資訊立法項目。

This paper briefly examines economic and legal issues raised by the licensing of electronic government information and publications. By reviewing comparative experiences from U.S. and our current regulatory scheme, it discusses some workable principles for the creation of licensing structure for electronic government information and publications. After the discussion on the above principles, this paper concludes that a more complete and consistent legal infrastructure, including intellectual property regulations concerning the license of electronic government information and publications as well as freedom of information act, is urgent and indispensable for the emerging electronic government age.
