以專利技術地圖為基礎發展專利佈局策略

摘要


當開發者進行專利佈局時,由專利地圖分析到專利佈局模式的決定,常常都是靠開發者主觀意識判斷,並無具體方式輔助實施專利佈局。本論文以專利技術地圖為基礎建立出一套完整的專利佈局策略,由開發者技術之檢視、專利技術地圖之建立、進而產生「合倂技術功效矩陣表」,經由專利技術指標之判讀,產生專利佈局模式之建議,接著可將開發者所擁有之技術依建議之專利佈局模式以策略性之方式做專利申請。本研究特別著重於如何針對開發者技術發展適合之專利佈局,開發者所擁有之技術將影響此策略中各個階段的判斷,故對專利佈局模式之選擇有絕對性的影響,不同的開發者技術所產生之專利佈局模式將一定會有所差異。本論文建立之專利佈局策略,首先檢視開發者所擁有之技術,整理出開發者可申請之專利項目,進而建立出開發者技術之技術功效矩陣表。除了瞭解開發者技術之外,還需要進一步瞭解先前技術位階及專利分佈狀況,針對先前技術進行專利資料庫檢索分析,進而建立先前技術之技術功效矩陣表。此時便可以將兩者技術功效矩陣表合併,產生之「合倂技術功效矩陣表」,觀察開發者技術與先前技術兩者所呈現的關係,確認開發者技術是否有新技術、新功效,並判斷是否可提出創新專利。這個步驟中同時也需要過濾重覆技術及功效,如開發者技術與先前技術重疊,判斷開發者技術是否已失去競爭力,此時只能刪除開發者技術,或建議採用迴避設計之方式,避開對手已佈署之專利進行專利申請。藉由本研究所使用之專利技術指標;技術生命週期圖、技術佔有率及技術獨立性,最後選擇出適合開發者技術之專利佈局模式。

When the developer have the decision of patent map analysis to patent portfolio strategies, the developer often rely on subjective judgments of consciousness. But there is no specific way to assist the implementation of patent portfolio strategies. This thesis is the development of patent portfolio strategies based on patent technology map. From the developer’s technology checking and the construction of patent technology map. It can produce a “Combined Technology Function Matrix”. From the judgment of “Technology index of patent”, it could get the suggestion of patent portfolio strategies mode. The developer can apply the patents base on their own technology and patent portfolio strategies mode.The thesis particularly focuses on how to develop suitable technologies for developers of proprietary patent portfolio strategies. The developer’s technology will affect the various decisions of this strategy and it will have absolutely impact for the choice of patent portfolio strategies mode. The different technologies of developers will have different patent portfolio strategies mode. The establishment of the patent portfolio strategy from this thesis will evaluate the technologies of developer first and collect the patent lists which the developer can apply. Second, it will construct the “Technology Function Matrix” by developer’s technology. Besides, it also needs to realize the condition of previous technology rank and distribution of patent. It has to search and analysis for the patent database of previous technology. And construct the “Technology Function Matrix” of previous technology. At this point we can merge the two “Technology Function Matrix” and get a “Combined Technology Function Matrix”. It needs to watch the relationship of developer technology and previous technology and confirm whether the developer technology has new technologies, new effects, and determine whether the proposed innovation patent. This step also requires filtration repeated technology and the effectiveness. Such like the developer’s technology is overlapping with the previous technology, it need to judge develop technology is loss competitiveness. At this time, it just can delete developer’s technology or recommended way to avoid design. It has been deployed to avoid the opponent's patent application. From the choice of Technology index of patent, such like “Technology Cycle Time”, “Technology Share”, and “Technology independent”. Finally, it can be choose the suitable patent portfolio strategies for developer technology.
