調查局與廉政署功能劃分之研究

The Study on the Function Division between MJIB and AAC

摘要


民國99年7月20日,因接連發生臺中警紀不彰、法官集體收賄等廉政醜聞,總統馬英九召開記者會,宣布將在行政院法務部下成立「廉政署」,以示政府清廉改革的決心。如今,法務部廉政署已於民國100年7月20日正式掛牌運作,但外界對於廉政署的架構及運作卻仍有許多質疑。此些爭議中,有很大一部分質疑來自於:在行政院法務部下,已有同屬三級機關的調查局在進行肅貪業務,廉政署似乎將產生與調查局疊床架屋的疑慮。而此即為本研究關注之焦點。 本研究首先從文獻分析中,利用「財產權理論」與「組織功能重疊論」兩種相異之論述,建立本研究之觀察框架,以探討我國肅貪體系在組織業務劃分不明確的情況下,較符合哪一派之說法;接著對於調查局人員、廉政署人員以及政風人員各群組進行深度訪談,以取得各方看法。訪談結果發現雖然各方看法有其特定立場及相異之處,但不同群組間對於如何減少調查局與廉政署之摩擦,並促進兩者之合作也有一定共識。 若由本研究之觀察框架來分析深度訪談內容,可發現從廉政署與調查局功能劃分不明確時產生的狀況來看,似乎較符合「財產權理論」之理論假設。針對目前我國肅貪體系所面臨之問題,本研究提出調查局定位調整、廉政署與調查局溝通平臺設置與加強廉政署人員訓練等建議,期待轉變為廉政署主導廉政偵辦與規劃,調查人員輔佐肅貪案件,政風人員致力於防貪、反貪與相關業務查處之分工模式,使各機關得以互相支援、相輔相成,共同將我國廉政體系推向嶄新局面。

After several government scandals including undisciplined police officers in Taichung, and a collective bribery of judges, President Ma Ying-jeou held a press conference on July 20, 2010, announcing Agency Against Corruption (hereunder referred to as AAC for short) will be set up under the Ministry of Justice, displaying the government’s determination to make reforms on integrity. The AAC has started its operations since July 20, 2011, yet doubts on its structure and operation still remain. Such disputes mainly lie in that Investigation Bureau, also a third-level government agency under the Ministry of Justice, has been responsible for anti-corruption for years, and the duties of AAC seems to overlap those of Investigation Bureau. This is the focus of this study. The current study first adopts literature analysis and employs the two divergent discourses, Property Rights Theory and Organizational Functions Overlapping, to build the framework of observations and explore which theory better accommodates our national anti-corruption system. Consequently in-depth interviews among staffers of AAC, Investigation Bureau and other ethics officials are undertaken, the result of which shows even as all parties have distinct stances and opinions, they have achieved a consensus on how to smooth over the disputes between AAC and Investigation Bureau and accelerate cooperation of both. From the analysis of in-depth interviews, we have found that, from the unclear division of functions of AAC and Investigation Bureau, Property Rights Theory can better explain our anti-corruption system. This study proposes that the adjustment of the position of Investigation Bureau, establishment of a communication platform between AAC and Investigation Bureau and enhancement of AAC staff training should be undertaken to improve the cooperative spirit of both agencies, which will lead our anti-corruption system to a brighter future.
