大陸台商勞動糾紛之研究

摘要


摘要 近年勞動糾紛問題頻傳,台商面臨最低工資的高漲、人民意識的提高、政府對於管工的權益保障,皆對台商產生影響。可發現台商從過去的軍事化管理到人性化的管理,面臨勞動糾紛問題,台商如何在制度上因應的措施,在人力資源績效上如何有效地提昇讓公司永續的發展。從人力資源管理作業上的制定,用人單位定期進行制度上的修正,調整符合當地員工的管理模式,降低勞動糾紛問題的發生。因此,本研究期望從不同的角度分析勞動糾紛對台商企業的影響,藉此提供給台商企業及未來將到中國大陸投資的企業更多的建議。 本研究以訪談台商為主,問卷的分析為輔助。故本研究的第二章至第四章從相關文獻的整理,分別探討勞動糾紛問題的類型、降低勞動糾紛的人力管理作業、勞動糾紛對人資績效的影響、勞動糾紛問題的解決對策為主題來加以探討。網路上個案的分析與進行台商個案的訪談,進行收集相關的勞動糾紛資料,並根據相關的文獻進行問卷設計,透過問卷的調查,人力資源管理作業其分析在勞動糾紛的問題下對台商是否產生影響, 得到台商最新的看法及問卷分析結果,研究結果驗證台商對勞動糾紛問題的看法,且具有分析數據做為輔助。 本研究的結果顯示,勞動糾紛的問題,可以靠人力資源管理作業的執行,減少問題的發生,並增加整體人力資源績效。而勞動糾紛問題較常發生於勞動力需求較高的產業,小規模的產業員工人數較少,較容易管理員工且人力資源管理制度較容易規範在勞動糾紛的問題發生頻繁,對人力資源績效會有負向的影響。本研究想藉此結果,對在中國大陸的台商提供降低勞動糾紛的方法及建議;除此之外,另提供未來將在中國大陸投資的台商提供因應對策。

Abstract Labor disputes happen frequently in recent years. Taiwanese Enterprises face with rising minimum wages, the improvement of people’s awareness and the foremans rights protection from the government. These problems all have impacts on Taiwanese Enterprises. We can find that Taiwanese Enterprises’ management change from militarized in the past to humanized while facing labor disputes; and Taiwanese Enterprises how to respond to the measure in the system and how to improve the performance of human resources effectively will let the corporation development sustainably. To reduce the occurrence of labor disputes must change from the formulation of human resource management operations, the regular institutional revision of employing units, and the suitable adjustment of management for local staff. Hence, this study expects to analyze the influences of labor disputes to Taiwanese Enterprises from different points of view, and thereby providing more recommendations to Taiwanese Enterprises and the companies who are going to invest in China in the future. This study is based on interviewing Taiwanese Enterprises, and supplement with the analysis of questionnaires. Therefore, the second and the forth chapter of this study is the compilation of relevant literature. And I will explore the following four themes respectively: the types of labor disputes, the management operation of reducing labor disputes, the effects of labor disputes to human resource performance, and the solution of labor disputes. Collecting related information of labor disputes from case studies on the web and interviews of Taiwanese Enterprises. And, a quentionnaire is designed according to relevant documants. Whether the analysis of human resource management operation will affect Taiwanese Enterprises under the issue of labor disputes or not, we will gain the newest point of view of Taiwanese Enterprises and the result of analysis through questionnaire. The result verifies Taiwanese Enterprises’ viewpoints and supplements with the analyzed statistics. This study shows that the problem of labor disputes can be reduced by conducting human resource management operation, and thus, increase the performance of whole human resource. And, labor disputes happen more often in the enterprises who needs higher labor force. It’s easier to manage employees and to operate the human resource management system in small-scale industries who have fewer employees. It will have negative impacts on human resource performances, if the labor disputes happen frequently. This study wants to provide methods and suggestions for Taiwanese Enterprises in China to reduce labor disputes by this result. Besides, this study also wants to supply Taiwanese companies who are going to invest in China in the future with strategies.
