衍生著作係就原著作加以改作所為之二次著作,其規範於我國著作權法第六條,並明文以獨立之著作保護。至於改作之方法另定義於第三條第一項第十一款,改作之類型我國法上之規範是否有所闕漏,抑或有待實務累積具體案型為首要之問題。此外衍生著作除須具備一般著作受保護要件外,更需探討其原創性何如,需達到何種程度始得獨立受著作權法保護。我國實務及學說並未針對衍生著作之原創作,有深入如比較法上之探討,因而對何種衍生著作具有原創性,有得受保護之價值,尚未建立一套標準仍有模糊之處。再者,衍生著作之成立乃基於原有之著作而來,因此衍生著作與原著作之關係亦影響到何人有權利用該衍生著作,此為我國法上所未明文,宜從學說及比較法之觀點剖悉。最後,關於衍生著作特殊之爭議問題,即將平面著作立體化,或立體著作平面化是否構成衍生著作,及需否以合法性為衍生著作之保護前提,皆為本文研究課題。 本文從衍生著作之概念及立法沿革出發,分析衍生著作之概念及內涵,爰採國際公約關於衍生著作之規範,進而探討原創性理論在衍生著作上之呈現,並檢視各國立法例如何運用此理論來建構對衍生著作保護之體系。於相關爭議問題爰採學說、比較法以及我國立法沿革以釐清採取最適觀點。並藉我國法院司法判決實務上之分析比較提出本文看法,盼能對釐清衍生著作之相關爭議問題有所裨益。
A derivative work is a work based upon other pre-existing works and granted copyright protection in Section 6 of the Copyright law. As for the definition of adaptation is qualified in Section 3, the first question is whether the definition of adaptation is too narrow to apply to all kinds of derivative works. Second, it is also essential to explore the originality of derivative works and the extent to which a copyright-protected derivative work comes into existence. Few cases and studies discuss the originality of derivative works as foreign law does in Taiwan. Therefore, there are no criteria by which a work qualifies as a derivative work and granted copyright protection. Third, the relationship between underlying works and derivative works affects that who has the right to use the derivative work. Finally, the special issues of derivative work, whether two-dimension work shifts to three-dimension work, constitute a derivative work and “lawfully” requirement is necessary to copyrightable derivative work. The research begins with the concept and the history of legislation of derivative works, analyzing the nature of the derivative work. Moreover, considering the theory of originality in international agreements, the study reviews the copyrightable system in the foreign law. Eventually, on the basis of the judgment of cases, we hope to make a contribution to the concept of the related issues of derivative works.
