探究我國國中少年性犯罪被害之原因－從日常活動與防衛空間的理論思考

摘要

性犯罪的定義大致包括性騷擾與性侵害二者。許多研究中，此二者最大差異處在於對人身侵犯的不同輕重程度；然而由於同樣都是環繞著「性」而對人身侵犯的行為、同樣都是性犯罪被害的高危險群，因此是本文的研究對象。據台灣官方統計資料顯示，國中階段少年們正是此性犯罪被害的高危險群，且比率逐年增加，值得相當重視。 本文使用Cohen和Felson的日常活動理論，並結合Newman的防衛空間理論，從犯罪被害人角度來理解性犯罪被害者可能被害的原因。使用台灣教育長期追蹤資料庫(TEPS)的資料分析，本文找出性犯罪被害的個人與家庭危險因子，以及容易發生性犯罪被害的時間與情境。前者包括個人屬性、偏差行為、自我認知、交友情形、家庭結構與親子互動等，後者包括個人作息、居住情形、學校管理、班級經營與關係連帶等。據此，形成性犯罪防制與保護的16種對策，針對危險因子加以關懷輔導，針對日常生活情境加以改善，針對防衛空間提出建言，藉以供相關單位參考，從被害者角度預防性犯罪的發生。

There are few studies and strategies in victims of sexual crime in the junior high school. But these juveniles are really violated large population. This paper used routine activity theory and defensible space theory to analysis sexual crime. Data were drawn from Surveys of Taiwan Education Panel Survey on students in junior high school. The results found that the key reasons of sexual crime were ”suitable violated targets” and ”absence of capable guardians”. Both of them were useful to explain sexual crime victims in the junior high school. This paper formed 16 kinds of situational crime preventable strategies to avoid and protect against the injury of sexual crime.
