營建產業專利佈局之研究—以建築預鑄為例

摘要


營建產業與其他產業相比,在遇到專利侵權問題時,無法快速掌握相關專利資訊,研究議題亦在少數。故本研究擬建置建築預鑄技術之專利地圖,分析該技術在專利上的發展現況與未來發展方向;並進一步解析技術及專利權人的專利佈局狀況,以藉由活用專利知識,提供建築預鑄技術之專利趨勢及專利技術資訊。 研究方法主要分為四個部份:文獻回顧、專家訪談、專利檢索及專利分析。分別在中華民國專利資訊網及美國專利暨商標局檢索專利資料,決定建築預鑄之最主要相關專利。於專利趨勢分析發現:技術生命週期已走向衰退階段;於專利技術分析發現:技術結構分佈以營造廠在現場施工所需之組立技術或裝置,以及結構組件之製造為主;於專利佈局模式分析發現:技術發展近似於策略型專利佈局模式。

When we encountered the issues of patent tort, it is tardy to get information and research topics, especially in the construction industry. For the information of patent can be used extensively. This research try to establish a patent map in precasting techniques of architecture, and also try to analyses the overall arrangement between current and oncoming tendency.The methodology of this research was literature study, interview from experts, patent search and analyses. The objects of this research were TWPAT and USPTO. In the tendency analyses of patent, we found that the life cycle of technology seems to turn down. In the technology analyses of patent, we found that the technology structure was widely distributed in field combination technical and installation, and the patent portfolio was “Strategic Patent Sarching”.
