鄉鎮市調解條例自民國四十四年公佈施行迄今已近五十年,對排解民間糾紛,疏減訴訟案件,維護社會秩序,促進社會和諧與團結貢獻良多。然而,隨著經濟發展,社會環境變遷,調解機制與運作是否受到影響?其設置宗旨與目標是否可以完全達成?在當前環境下,其組織結構與調解績效是否有改善空間?如果沒有,未來應如何改進? 本研究以桃園縣鄉鎮市調解委員會組織功能與實務運作現況做為研究對象,除收集近十年來鄉鎮市調解業務概況資料,做系統分析及績效評量外,並設計訪談問卷,針對鄉鎮市調解委員會如何推展調解行政工作、提升調解委員及秘書專業素養、加強組織功能、提升調解績效、充實及改善調解環境等問題為範疇。並以桃園縣調解委員會資深的成員為對象,進行個別深度訪談,從中瞭解目前各鄉鎮市調解委員會運作實際現況,以探求存在之問題與缺失,並提出具體改進與建議。
It has been almost 50 years since the declaration and commencement of the Ordinance of Municipal Arbitration in 1955.The municipal arbitration system has contributed significantly toward reconciling ordinary conflicts , reducing the numbers of law suits, maintaining the order of society, and enhancing the harmony and unity of whole society. However, has the arbitration system and application been influenced by the economic development and the change of societal environment ? Can it reach its full achievement in its objectives and goals? And at present time, is there still any room for improving the existing system and its effectiveness of arbitration ? If not , how to make it happen in the future? The present study investigates the system functionality and application of Municipal Arbitration Committee in Tao Yuan County nowadays. In addition to collecting data for administration of municipal arbitration in the past ten years, and conducting systematic analysis and data evaluation, a questionnaire has been designed to encompass the following topics: how does the Municipal Arbitration Committee carry out the administrative work, how to promote the professionalism of arbitration committee members and secretary , how to strengthen the system functionality, how to enhance the arbitration effectiveness , and how to improve the environment of arbitration system . The individual in- depth interview was conducted with the senior arbitration committee members in Tao Yuan County, with the objectives of understanding the practical application of Municipal Arbitration Committee , exploring the deficiency of existing system, and identifying some feasible suggestions and potential ways of improvement.
