近年來在民主政治的潮流下,人民的程序參與權利日漸受到重視,本論文題目主要就是在探討都市計畫法中有關人民參與的議題,首先檢討現行法中都市計畫有關民眾參與部分的優缺得失,再參酌與外國立法例的比較,並提出具體的修法建議。 全文可分為六個章節,第一章緒論、第二章介紹人民參與之涵義及其理念依據,其憲法依據主要有二,一為法治國原則;另一為民主國原則。在法治國原則,本文著重於人民權利之維護的探討,在民主國原則,本文則聚焦於行政行為的民主正當性。第三章是探討我國都市計畫法,並介紹都市計畫之流程,從都市計畫法第19 條延伸,可以發現我國的民眾參與制度面上缺乏資訊公開的機制、參與的時機過晚以致難以發揮有效的公共參與機能等缺失。顯然的,我國現行的都市計畫法制對民眾參與權利之保障仍不充分。第四章為外國都市計畫有關公眾參與制度之介紹與評析,英國的都市計畫擬定和開發管制,皆有充分的民眾參與的機制;美國的都市計畫擬定過程有民眾參與其中,其內容包含民意調查、資訊公開、提供彙整建議或預先擬定計畫、舉辦聽證會等,甚至採用公民投票的直接民主方式。第五章則探討都市計畫程序之性質,及我國行政程序法及其他相關法規中的民眾參與制度,舉凡陳述意見、說明會、公聽會、聽證等,比較其異同,並評析其於都市計畫法適用之可行性。 最後,本文認為都市計畫有引進聽證程序之必要,並提出都市計畫法第19 條修正建議,使人民參與制度及精神能在都市計畫程序充分地落實。
In Recent years, safeguarding people’s rights of participation and property and supervising government are more and more important. The main point of this thesis is to explore issues relating to citizen participation in urban planning law.First, reviewing the advantages and disadvantages on citizen participation in the existing urban planning laws. Consulting and further comparing with the legislation of other countries. And make the specific recommendations of amendment of the law. The thesis can be divided into six chapters. Chapter 1 is Introduction. The second chapter describes the meaning of citizen participation and its basis. The constitutional basis consists of two parts. One is the principle of rule of law, the other is the principle of democracy. This thesis focuses on the protection of people's rights. And then, the thesis will focus on the legitimacy of democracy in administrative actions. The thirdchapter is to explore urban planning laws in this country, and describes the process ofurban planning. Interpretation from the 19th article of the Urban Planning Law, we can find the system of citizen participation in this country lack of mechanism for information disclosure, and its timing is too late for effective function. Obviously, the rights of citizen participation in existing urban planning law are still inadequate. The fourth chapter is about the introduction and comment of citizen participation in foreign urban planning. There are sufficient mechanisms of citizen participation in the make of British urban planning and development control. Citizens can be involved in America's urban planning process , which contains the survey, the disclosure of information, making advice or plans in advance, holding hearings, and even the use of referendum. The fifth chapter explores the nature of urban planning program, Administrative Procedure Act and other relevant laws and regulations of citizen participation in the system, which covers that can be heard, briefings, public hearings,hearings, etc. Then comparing the similarities and differences among them, and the V feasibility of adoption in the Urban Planning Act. Finally, the thesis that the necessities of hearing in the 19th article of the Urban Planning Act in order to implement the spirit of citizen participation.
