私立大專院校之數量及學生人數,均占全國大專院校的3分之2,遠逾公立大專院校,其地位與重要性應予高度重視。學校固有公私之分,然人才培育應無公私之別。私立大專院校享有憲法上學術自由、大學自治及私人興學自由之保障,教育人員任用條例第2條雖將其適用範圍限定為公立學校。然同條例第41條規定:私立學校校長、教師之任用資格及其審查程序,准用本條例之規定。故教育人員任用條例之規定,將一體適用於公私立學校。法律規範公私立學校教師雖無太大之形式上差異,惟在現實狀況下,公私立學校教師仍難免有實質上之差異。 本研究之結論認為政府應給予私立大專院校支援與自主空間,且私立大專院校與教師之聘任關係屬私法契約。基於上述之結論,分就制度面及救濟方式等議題,提出本研究之建議,以期提供司法實務及教育主管機關參考。制度面之建議為廢除三級教評會、應避免校教評會過度依賴外審意見、避免校教評凌駕於系院教評會、教評會盡量不採取停聘手段、教評會不得推翻具專業性的委員會之調查結果,以及避免教評會權限過大等等。而救濟方式上之建議,則為避免救濟程序複雜化、廢除再申訴制度、主管教育行政機關應參加行政救濟程序、應統一教育部核准之性質。
The number and students of private colleges and universities are two-thirds of all colleges and universities in Taiwan and more than public ones. Their position and importance should be highly emphasized. Talent training makes no difference between public and private schools. Private colleges or universities possess constitutional academic freedom, university self-government, and private educational freedom. Although Article 2 of Act of Governing the Appointment of Educators refers to public schools, Article 41 provides that the appointment qualifications and the screening procedures of the private school principals and teachers shall apply mutatis mutandis to the provisions of the Act. Therefore Act of Governing the Appointment of Educators applies to public and private schools. The essence of teachers from public or private ones is still a little bit different in current conditions although there is almost no formal diversity of laws. The conclusion of the study is that the Government should offer private colleges and universities support and autonomy, and the engagement relation between private colleges or universities and teachers belongs to a kind of private contract. According to the conclusion, the suggestions of the study are divided into two parts, the system and the remedy. The suggestions on the system are to remove the 3-Rank Teacher Review Committee and that Teacher Review Committee of the university shouldn’t override Teacher Review Committee of the department or college, and Teacher Review Committee should avoid adopting suspension, can’t reverse an investigation result from a professional committee, and shouldn’t exceed its power. As for the suggestions on the remedy, avoid complication of the remedial procedures, remove the re-appeal system, unify the nature of approval from the Ministry of Education, and the competent educational authorities should take part in procedures for administrative remedies.
