台灣已邁入高齡化社會,人口老化衍生的相關醫療照護、年金給付、住宅及社會服務需求及扶養負擔提高,亟待正視,未來住宅規劃、建築、設施必須切合人口老化的需求。為因應上述趨勢,本署配合內政部社會司已陸續研訂或修訂銀髮住宅的相關法規。 本文將有關銀髮住宅的相關法規分為申請設置與營運管理以及實質空間與環境設計兩大類,涉及申請設置與營運管理方面有老人福利法、老人福利法施行細則及老人住宅綜合管理要點,涉及實質空間與環境設計方面有建築技術規則建築設計施工編老人住宅專章之老人住宅基本設施及設備規劃設計規範。 本署盱衡當前國內政經發展,因應國際社會住宅趨勢,檢視整體住宅發展現況,特擬定「整體住宅政策」,業奉行政院2005年5月24日核定。有關老人住宅方面,係將老人視為弱勢國民,優先予以輔助,並積極推動涵括老人住宅設計規劃理念之無障礙住宅及社區環境,以增加符合老人需求之住宅供給。
As Taiwan has launched into an aging society, eldercare, annual elderly pension payment, and the increasing demand for related housing and social services have become critical issues to be taken into consideration in the planning and construction of senior housing facilities in the future. In order to meet these demands, the Construction and Planning Agency has cooperated with the Department of Social Affairs to draft and amend the laws related to senior citizen' housing. The paper introduces regulations related to senior citizen' housing that can be divided into two major categories: firstly, the regulations concern the application of building approval and the operation and management of senior housing facilities as stipulated in the Elderly Welfare Act and its Enforcement Rules, and the Rules on General Management for Elderly Housing Facilities; and secondly, the regulations related to the design of physical space and environment as included in the Sections on Building Design and Construction and the special chapter on Elderly Housing of the Technical Regulations for Building Construction and Regulations on Planning and Design of Elderly Housing Infrastructure and Facilities. In response to the domestic political and economic development and global trend in social housing, the Agency has examined the general status of housing development in Taiwan and drafted the ”Overall Housing Policy” that has been approved by the Executive Yuan on May 24, 2005. The Policy regards the elderly as a disadvantaged group and strives to give priority in meeting their needs. Moreover, design, planning, and construction of accessible housing and communities for the elderly will be promoted actively in order to meet the special needs of our senior citizens.
