現代行政法,其實存在著一種矛盾:一方面要實現行政目的,達成國家任務,遵守依法行政(rule of law),維持法律之穩定;但另一方面,卻因為現在政治經濟社會變化非常劇烈,而行政與人民之權利義務往往是息息相關,因此,為達成國家任務,行政不得不做一些選擇,以切實符合此種需求。 而在全球化的浪潮下,可以發現這種變化越發明顯,為了迎合全球化所導致的競爭(competition),因此「民營化」(privatization),「法規鬆綁」(deregulation)等概念相繼影響了現代行政法的風貌,也使得過去一個世紀以來,國家與人民間的契約關係產生變化。 最明顯的情況是,國家對於許多與人民相關的部份,在「治理」(Goverance)的概念上做了重大的轉變,將原本屬於國家公共行政的任務,轉讓給了私人或由國家與私人共同經營,因此各種BOT,OT,ROT的形式便應運而生,也使得行政主體在選擇其行為之法律形式上,更具多樣性。 但是,對上述這種演變,其實就實質而言,已經侵蝕了國家的存在目的,也有可能違反了國家對人民的保護義務。因此,如何建立一套機制,甚至劃定一定的界線,以規範國家大量運用行政私法之形式,實為目前之當務之急。
There exists a contradictory about current administration law: we have to obey the rule of law to achieve the purpose of administration. However, due to the dramatic changes of nowadays’ politics and economics and the truth that administration is closely related to people’s right and obligation, we cannot help but have to do some changes about administration. Due to the competition from globalization, the concepts of privatization and deregulation influence the original administration law. During the past century, the constitution has transformed. The most obvious situation is that the idea of governance has been altered a lot. For instance, the public administration transforms to privatization or the operation between government and private enterprise (e.g. the forms of BOT、OT and ROT). In fact, the transformation damages the country’s obligation to people protection. Therefore, the most important method is to build appropriate rules in order to apply administration private law in governance.
