台灣公共工程履約爭議民事訴訟一審判決對數線性模型解析

Applying Log-linear Model for Interpretation of Public Work's Civil Litigation Scenario of First Instance Review in Taiwan

摘要


公共工程履約爭議之研究,既往多直觀取材逕自微觀,鮮少符合統計檢定。本文普查1999年至2008年,台灣高等法院及各分院民事訴訟判決業主敗訴案件共400件,以類目分析編碼回溯建構一審判決對數線性模型。本文主要發現:(1)工程專業機關較易涉訟、(2)政府採購法施行對縮短訴訟時間具有貢獻、(3)地院平均一審維持率52.38%、(4)一審判決機關敗訴之勝算比存有地域上之差異、(5)類目分析方法對於複雜的工程法務研究,具體可行。

In this paper, 400 civil litigation cases with government agencies involved in the period of 1999 ~ 2008 in Taiwan were collected. Loglinear model was applied for their quantitative interpretation. The results of this paper were derived based on statistical tests to supplement the gap of related studies in the past. The main findings are as follows. The Government Procurement Law has positive contribution on the reduction of litigation time. Engineering professional agencies, when comparing to non-engineering professional agencies, were prone to the involvements of litigations. And, the misjudged rates of the First instance review of District Court houses in different areas are different.
