派遣勞動於勞工退休金條例適用之研究-以退休金提撥為中心

摘要


隨著科技日新月異、各種專門職業技術分工漸細、企業發展與佈局的全球化,為了在競爭中勝出,不斷提升服務及產品的品質並壓低生產成本,已成為各國企業的共通課題。因此,將企業內非核心業務以派遣勞動等非典型勞動型態處理,遂成為大勢所趨,以有效降低人力成本並兼顧勞動力的質量,我國亦未置外於此種風潮。為保障為數漸多的派遣勞工之老年經濟生活,我國勞工退休金條例亦將派遣勞動等非典型勞動納入適用,然而,該條例設計上乃針對傳統典型勞動型態,與派遣勞動之法理難免有扞格之處。筆者觀察勞退條例實施後之實務見解,其中與派遣勞動之特殊三方法律關係攸關者,爭點多集中在勞動契約之存在及相應之雇主給付義務之歸屬,且均為運用個人帳戶制之勞動者。爰此,本文將以上開爭點為核心,藉由派遣勞動基本關係與勞工退休金條例體制上若干基本概念之釐清,探討該等爭議,並提出合理的解決之道。 除緒論合先說明相關研究動機與研究對象及方法外(第一章),本文首先釐清派遣勞動之相關概念、我國發展現況,並進而架構出此三方法律關係內涵,再藉由對我國勞工退休金法制之歷來變遷、重大改革方向及相關學說實務之整理,以釐清勞工退休金條例之立法目的與相關基本概念意涵。最後,透過觀察法院實務對派遣勞動適用勞工退休金條例所生爭議之處理方式,對其曖昧不明處提出問題。(第二章)為就上開問題尋求日本法制解答,爰說明日本派遣勞動制度及退職金或企業年金制度之梗概,並分就勞動者派遣法制定前後,整理日本派遣勞動關於退職金爭議之實務見解,探討實務上如何應用雇主責任分配之法理基礎與相關學說理論,釐清派遣勞動中應負退休金給付責任之雇主為誰,作為我國參考。(第三章)以前揭日本法制實務及學說見解為基礎,對我國未來法制上應有之考量提出檢討。就勞工退休金條例而言,不但須考量強制雇主提繳退休金之合理性,就雇主之定義、退休金之性質與計算基準等也有討論空間。就派遣勞動而言,思考未來立法之必要性,並進一步檢討在未立法規範前,派遣勞動三方關係中,退休金給付義務者之確立原則,與例外情形下雇主責任應如何分配,思考日本作法在我國有無適用空間。(第四章)最後,將本文重點作一摘要整理,並就派遣勞動在適用勞工退休金條例時應如何分配雇主責任等問題提出個人淺見,作為總結。(第五章)

With the rapid development of the economy and the technology, now all enterprises are unavoidable to face the global competition. In order to be the winner of the competition, more and more enterprises use dispatched employment to reducing the personnel cost. Meanwhile, the development of the economy and technology also causes the increasing of elder population. To maintain the living standard of labors after their retirement, Labor Pension Act was enforced in July 1, 2005. It is said that the personal account of this act can make the dispatched employees get their pension. However, because of the paradoxical definition of employer under Labor Pension Act and dispatched employment, it’s a difficult and important judicial problem to find out who is the “real employer” under the obligation to give the pension. This thesis first analyses the definition and legal relationships of dispatched employment and also explains the purpose and the legal nature of pension under Labor Pension Act by researching legislations, literature and current judicial systems in our country. Based on the above-mentioned ideas, we discuss the practice opinions of the application of dispatched employment under Labor Pension Act to find out the problems in identifying employer’s liability to give the pension.(Chapter 2) Secondly, the thesis introduces the related regulations and practice modes in similar situation in Japan to provide hints on the solutions to the above problems. (Chapter 3) Thirdly, by researching and comparing the advantage of Japanese experience, some concepts helpful to solve the problems are discussed. (Chapter 4) At last, it provides the conclusions of this study and the suggestions for future legislation. Through clarifying the duty of payment in dispatched employment under Labor Pension Act, this study expects to achieve the protection of the elder financial security of employees of dispatched employment after their retirement.(Chapter 5)
