歷經15 年等待,公務人員行政中立法終於立法通過,這本該是令人慶幸的事情,最符合民主法治國家的事,即國家對於人民、各政黨及政治團體一視同仁。為使大眾能夠透過意見之表達、交換與溝通,呈現各種意見與資訊,可以提供社會大眾依照民主程序參與政治活動決定時所需要的資訊,以使人民基於正確的資訊,依照其理性做出正確的政治決定,忌諱國家利用執政優勢,提供行政資源於特定人民、政黨或政治團體,以免造成資源、資訊的不對等,無從達成民主政治之理念。公務員為國家職務擔當人,執行公權力,其自然必須與各政黨保持距離、依法行政、無所偏頗,使人民得以信賴國家作為。公務員既然須在政治上保持中立,自然在其執行職務時須維持行政中立。 本篇論文從憲法保障人民表現自由出發,探討公務員具備特別身分關係時,言論自由之保障是否須退讓。其後,再論述新通過之行政中立法之缺失,期待未來能做更詳盡之修法。
After 15 years, Administrative Neutrality Law was finally passed. It should be a pleasing thing for a democratic country but there is a concern if it will trespass public service’s freedom of expression. In a democratic country, everyone is equal no matter who they are and which public party or group they belong to. Given enough information, people can make the correct public decision rationally. To reach the ideals of democracy, it is prohibited for the government to take advantage of its power based on its authority to benefit certain people, public party or group and in order not to cause resource and information asymmetry. This essay will explore from the freedom of expression protected in constitution to discuss if there is a need for public service officials to give in the freedom of expression when there is special duty relationship and further discuss the flaw of Administrative Neutrality Law in order to provide suggestions for future thorough amendmen.
