我國營業秘密保護要件及其相關判決評析

摘要

資訊科技帶動全球經濟蓬勃發展，知識儼然成為企業強盛之關鍵因素。事業經營者除積極管理公司有形資產，企業經濟價值和財富的來源，已逐漸依賴無形資產的創造和運用，如何將營業秘密之保護，轉變為公司競爭之基石，遂成為企業經營者不可輕忽之重要。本文首先論述我國營業秘密法之保護理論，其次說明園內最新相關實務之運作，藉此從營業秘密之模糊概念，得以明證其體之案例細節，並對營業秘密之要件認定，邁向一般化之合理分析。最後，本文嘗試將學理剖析具體判決以作為結論。

With the increasing economic value of intellectual property, it is imperative that trade secrets be protected from both domestic and foreign thieves. This paper discusses the Taiwan Trade Secret Law (1995) and intends to suggest the new statutes. First of all, this paper introduces trade secret protection theories. Secondly, this paper will introduce cases happened in Taiwan and the other related statutes. Finally, this paper will provide the suggestions of proposed amendments for ROC Trade Secret Act.
