都市計畫乙種工業區閒置土地使用管制之研究-以新店區都市計畫為例

摘要


近年來因產業結構改變、都市發展重心轉移等影響,造成國內產業紛紛外移。而隨著交通便捷發展,使得都市生活圈不斷擴張,原有位於郊區都市計畫工業區土地逐漸成為新興發展地帶,當都市計畫工業區閒置土地影響了都市區域發展,如何有效利用土地資源成為現今都市發展很重要之課題。早期都市計畫原意設置工業區是為了滿足當時產業快速發展的需求,隨著產業結構的變遷與大型工業區不斷開發,使得都市計畫工業區難以競爭生存,導致土地閒置荒蕪,然而受限於法令制度難以即時調整配合地區發展。當都市中工業區土地的價值不斷上升,面對區位與市場的需求,工業區土地變得炙手可熱。因此本研究探討都市計畫乙種工業區閒置土地面臨產業發展與地區發展中,容許使用管制來有效控制都市土地資源,並且提升都市區域發展和產業再造。 本研究透過文獻回顧與理論研究,並以國外工業區再發展相關案例分析研究,歸納整理法令制度、管理輔導、規劃設計與市場需求四個面向,探討都市計畫乙種工業區閒置土地使用制度。研究發現其土地閒置原因多為產業結構改變外移、土地開發成本過高、地主無變更意願、土地投機操作與違規使用等等。面對新北市新店區都市計畫乙種工業區土地使用現況,針對與土地使用管制相關的單位及個人如:中央政府、地方政府、專家學者、土地開發業者、土地所有權人進行深度訪談研究,以各單位立場思考角度不同分析其訪談內容,研擬都市計畫乙種工業區閒置土地使用管制課題與對策,進而提出都市計畫工業區土地合理合宜之使用策略,以供未來政府制定或修改相關法令之參考。

In recent years, the industrial structure change and effects of urban development's core part shifting, have caused domestic industry relocation. However, with the convenient transportation development, urban areas are expanding, also, urban planning industrial estate becoming the new development zones which locate in the outskirts originally. When Vacant lands on urban planning industrial estate affect the development of urban areas, how to use land resources efficiently has become important issues in urban development. Early urban planning aimed at meeting the demand of industrial areas' development with the change of industrial structure and exploitation of dense industry, urban industrial planning is hard to survive, as well as the land resources which are limited by decrees become Vacant widely and aren't able to adjust regional development. When increasing of land's value in urban industrial, industrial areas become important when facing the meet of location and market. Above all, this study researches the using of permissible land resources efficiently in accordance with decree under the development of industry and region in urban planning category B industrial estate on urban planning, and enhances the urban areas development and industrial reconstruction. After literature review, theoretical research and foreign Industrial redevelopment case study, the research of using system on Vacant land in category B industrial areas is based on collating law institutions, management tutor, planning design and market demand. The study found that the reason of Vacant land mostly are change of industry's relocation, high cost of land development, unchanged willing of landowners, land speculation and illegal usage. Currently, Facing with the usage of land in New Taipei City Xindian areas urban planning category B industrial estate, and interviewing related units that aimed at permission related units such as: central government; local governments, experts, scholars, land development explorers, and landowners. Later, to think their respective positions and analyze interviews before to propose the issues and countermeasures upon land usage in urban planning category B industrial estate, and then, to put forward the proper countermeasures of land usage strategy which are provided to government for formulating and altering related institution in the future.
